Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the BorrowCash mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you ("User," "you," or "your") and BorrowCash Ltd ("BorrowCash," "we," "us," or "our").

2. Description of Service

2.1 What BorrowCash Is

BorrowCash is a loan discovery and comparison platform. We:

• Help you find loan offers from Nigerian lenders
• Display advertisements from lenders and financial institutions
• Provide a user-friendly interface to compare loan terms

2.2 What BorrowCash Is NOT

All loan offers you see are advertisements from third-party lenders. When you click an ad, you are redirected to that lender's website or application, where their terms and conditions apply.

3. Eligibility

To use BorrowCash, you must:

• Be at least 18 years old
• Be a resident of Nigeria or accessing the App from Nigeria
• Have the legal capacity to enter into binding contracts
• Not be prohibited from using the App under Nigerian law

By using the App, you represent and warrant that you meet these eligibility requirements.

4. User Obligations

4.1 Acceptable Use

You agree to use BorrowCash only for lawful purposes. You will NOT:

• Use the App for fraudulent activities
• Attempt to reverse engineer, decompile, or hack the App
• Submit false or misleading information
• Interfere with the App's operation or security
• Use automated tools (bots, scrapers) to access the App
• Violate any applicable laws or regulations

4.2 Account Security

While BorrowCash does not require account creation, you are responsible for:

• Securing your device
• Preventing unauthorized access to the App on your device
• Any activity that occurs through your device

5. Advertising and Third-Party Content

5.1 Ad-Supported Model

BorrowCash is free to use because we earn revenue from advertisements. By using the App, you understand and accept that:

• Ads are displayed throughout the App
• Ads are served by Google AdMob and other ad networks
• Ad content is selected by algorithms based on contextual signals
• We cannot control which specific ads you see

5.2 Third-Party Lenders

When you click an advertisement for a loan offer:

• You leave BorrowCash and enter a third-party website/app
• That lender's terms, privacy policy, and fees apply
• BorrowCash is not responsible for the lender's actions
• Any disputes are between you and that lender

5.3 No Endorsement

The presence of an advertiser in BorrowCash does NOT constitute an endorsement, recommendation, or guarantee by BorrowCash. We do not verify lenders' claims or loan terms.

6. Intellectual Property

All content in the BorrowCash App, including but not limited to:

• App design, layout, and user interface
• BorrowCash logo, trademarks, and branding
• Text, images, graphics, and icons
• Software code and functionality

is owned by BorrowCash Ltd and protected by Nigerian and international copyright, trademark, and intellectual property laws.

You may NOT:

• Copy, reproduce, or distribute App content
• Use our trademarks without written permission
• Create derivative works based on the App

7. Disclaimers

7.1 "As-Is" Service

BorrowCash is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to:

• Warranties of merchantability or fitness for a particular purpose
• Accuracy, reliability, or completeness of loan information
• Uninterrupted or error-free operation
• Security or freedom from viruses

7.2 No Loan Guarantee

BorrowCash does NOT guarantee:

• That you will be approved for a loan
• Any specific loan terms, rates, or amounts
• That advertised lenders are currently accepting applications
• The accuracy of lender-provided information in ads

7.3 Financial Advice

BorrowCash does NOT provide financial, legal, or tax advice. The App is for informational purposes only. Consult qualified professionals before making financial decisions.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW:

BorrowCash, its officers, directors, employees, and affiliates shall NOT be liable for any:

• Direct damages: Lost profits, data loss, or business interruption
• Indirect damages: Consequential, incidental, special, or punitive damages
• Third-party actions: Actions, omissions, or conduct of lenders or advertisers
• Loan outcomes: Denied applications, unfavorable terms, or lender disputes

This applies even if we were advised of the possibility of such damages.

Maximum liability: In no event shall BorrowCash's total liability exceed ₦10,000 NGN.

9. Indemnification

You agree to indemnify, defend, and hold harmless BorrowCash and its affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use or misuse of the App
• Your violation of these Terms
• Your violation of any law or third-party rights
• Disputes with lenders you contact through the App

10. Privacy

Your use of BorrowCash is also governed by our Privacy Policy.

Key points:

• We collect minimal, anonymous data
• We do NOT collect personal information (name, email, phone, BVN)
• Search criteria are temporary and not stored
• Advertising data is managed by Google AdMob

11. Termination

11.1 Your Right to Terminate

You may stop using BorrowCash at any time by uninstalling the App from your device.

11.2 Our Right to Terminate

We reserve the right to:

• Suspend or terminate your access to the App
• Modify or discontinue the App (or any part of it)
• Do so at any time, with or without notice

Reasons for termination may include:

• Violation of these Terms
• Fraudulent or illegal activity
• Requests from law enforcement
• Business or technical reasons

12. Changes to Terms

We may update these Terms from time to time. When we do:

• The "Effective Date" at the top will change
• Material changes will be notified via in-app banner
• Updated Terms will be posted at borrowcash.ng/terms

Your continued use of the App after changes constitutes acceptance of the new Terms.

13. Governing Law and Dispute Resolution

13.1 Governing Law

These Terms are governed by the laws of the Federal Republic of Nigeria.

13.2 Dispute Resolution

In the event of any dispute arising from these Terms:

1. Informal Resolution: Contact us at support@borrowcash.space to resolve amicably
2. Mediation: If informal resolution fails, disputes will be submitted to mediation in Nigeria
3. Arbitration: Unresolved disputes will be settled by binding arbitration under Nigerian Arbitration and Conciliation Act

13.3 Jurisdiction

You agree to submit to the exclusive jurisdiction of the courts in Nigeria for any disputes not resolved through arbitration.

14. General Provisions

14.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and BorrowCash regarding use of the App.

14.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

14.3 Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.

14.4 Assignment

You may not assign or transfer these Terms. We may assign our rights and obligations without restriction.

14.5 Force Majeure

BorrowCash is not liable for failure to perform due to circumstances beyond our reasonable control (natural disasters, government actions, internet outages, etc.).
